The fundamental problem is that there is this misguided belief that the judicial council and the AOC are honest, ethical and beyond reproach. There is this misguided belief that people who meet only about six times a year can manage a multi-billion dollar budget or oversee an office like the AOC that is spending most of that multi-bilion dollar budget.

One only needs to look at the pages here and the history of previous votes to see that the judicial council and the AOC are partners engaged in unprecedented self-dealing and that keeping trial court doors open isn’t even on their radar nor does it hold any importance. The Judicial Council as presently formed consists of a large majority of yes men and women and insiders who have something to gain or lose by pulling the party line and speaking with one voice. God forbid that we have any democratic dissension as representative government gets messy and sends out confusing messages. Instead, the Judicial Branch is governed by appointees that are all appointed based on their ability to go along and get along.

The crippled law firm Dewey & Leboeuf LLP filed for Chapter 11 bankruptcy protection Monday night and will seek approval to liquidate its business after failing to find a merger partner, marking the biggest collapse of a law firm in U.S. history.

Once one of the largest law firms in the U.S., Dewey has been hit by the loss of the vast majority of its roughly 300 partners to other firms amid concerns about compensation and a heavy debt load.

“Clearly, this situation should never have happened, and we are sorry that it did. It is not the way we do business, and we believe it would not happen in our company today,” the utility said.

The apology marked a bittersweet victory in Hinkley, Calif., where residents have blamed cancer deaths and birth defects on the polluted water.

“Well, I think it’s great because a lot of [residents] do have health problems,” said Brenda McIlvain, a bar owner whose ex-husband will benefit from the settlement. “I think it’s great that the ones that signed up on the [lawsuit] will get a little bit of money to help them.”

The settlement comes before the trial was supposed to begin and ends the majority of the claims from Hinkley and other towns, including Kettleman Hills, that said their groundwater was contaminated.

“This closes the books on almost all the claims,” said Jon Tremayne, a spokesman for PG&E. “The settlement provides closure, and it allows us to focus on the future. We’re hopeful it will provide closure for the plaintiffs and allow them to move forward.”

The case dated to 1951, when spent chromium, added to cooling water to reduce corrosion, leaked from unlined retention ponds and seeped into the groundwater under Hinkley, making its way into community wells. The plaintiffs’ attorneys claimed that some of the town’s water supply was tainted with 140 times the amount of chromium allowed under government standards. They suggested that most of the cancers were caused when children played in the water and inhaled particles.

In July 1996, PG&E agreed to pay $333 million to about 650 people who blamed cancer and other diseases on polluted water leaking from a gas pumping station.

Judge William Fletcher, a member of the Ninth Circuit panel that adjudicated the matter of In re Girardi, 08-80090, rejected the lenient recommendations of Rory Little. He stated: “with any competent lawyer if you’re omitting part of a document, that is not accidental. That is intentional.” The court adjudicated that the grave misconduct by Walter Lack and Thomas Girardi included “the persistent use of known falsehoods,” and that the “false representations” were made “knowingly, intentionally, and recklessly” during years of litigation.

Los Angeles Superior Court Judge Aviva Bobb was elevated to the Superior Court in 1994.  In 1998 she moved to family law and served as Supervising Judge of both the family law department (2000-2004) and the probate department (2005-2009), where she presided over many high-profile and celebrity cases.

Separately, in connection with the suit against Bet Tzedek, Ronald George, and Eric George, data provides that “Eric George’s deposition with a substantial document request is set for end of June, 2012, and Moreno’s with a substantial document request for mid-July, 2012.”

Ronald Marc George — the former Chief Justice of the California Supreme Court who stand accused of embezzling funds — will be asked to produce documentation relating to his ownership of an estate in Beverly Hills, as well as his ownership of a condominium located in the Nob Hill neighborhood of San Francisco.

As part of maintaining the scheme, the suit alleges, AOC employees Ronald Overholt and William Vickery were bestowed with various gifts, trips, kickbacks, bribes, excessive salaries, and the like. Similarly, and also as part of guarding the scheme, the suit alleges that defendants, at times, resorted to utilizing the services of Tom Layton — a former Los Angeles Deputy Sheriff/Senior State Bar of California investigator — to “illegally gather detrimental dirt” on various individuals who would oppose and/or object to the existence of said arrangements.

Trial dates were set Monday in the California State Bar discipline case filed in May against Del Norte County District Attorney Jon Alexander.

California State Bar Court Judge Lucy Armendariz set the case for a Sept. 4 to Sept. 7 trial during Monday’s status conference, according to the state bar. A status conference is a pre-hearing meeting of attorneys before a judge to discuss how a case is proceeding.

The next status conference is scheduled for 9:30 a.m. on Aug. 13. The conference will take place at the California State Bar Main Office, 180 Howard St., in San Francisco. The courtroom will be open to the public.

Attorneys Robert Sullivan and Kurt Melchior with Nossaman LLP are representing Alexander.

Alexander said the case against him is unwarranted and that he’s frustrated Del Norte County hasn’t offered legal representation on his behalf.

Amid conflicting reports, suspicious circumstances and vexing question, The Leslie Brodie Report has launched a journalistic inquiry into the unsettling relationship between Tom Girardi of Girardi & Keese, Eric George, and former Chief Justice of the State of California – Ronald George.

Gottschalk, an accomplished attorney with a stellar record who served as Girardi’s co-counsel in class-action litigation, has been the victim of grave injustices and systemic abuses from various local and state entities ever since his relationship with Girardi soured.

Specifically, Gottschalk and Girardi & Keese’s Thomas Girardi were co-counsel representing plaintiffs in various actions. Once a dispute erupted between Gottschalk and Girardi, the State Bar of California came knocking on Gottschalk’s door. 

However, realizing that the evidence against Gottschalk is weak and not credible at the extreme, the State Bar of California obtained a default judgment against Gottschalk during a time period which the State Bar knew Mr. Gottschalk was unavailable. Participating in the scheme against Gottschalk were Mr. Paul O’Brien from the Office of Chief Trial Counsel and Judge Patrice McElroy.

Gottschalk’s lawyer– Mr. Stanley Arouty– submitted a sworn statement to the California Supreme Court accusing McElroy of intentionally destroying an audio tape which serves as the official court record. (See excerpts from Arouty’s declaration above)

Shockingly, however, despite the close personal relationship between Ronald George, Tom Girardi, and Eric George, once the California Supreme Court was asked to review the Matter of Gottschalk, then Chief-Justice Ronald George did not recuse himself while ruling to disbar Gottschalk.

This despite the questionable ethics of Judge Patrice McElroy of the State Bar Court.  As mentioned previously, during a hearing presided over by McElroy, she disclosed that Peter G. Keane — who was then Dean of Golden Gate University School of Law and was representing an adverse witness (Ms. Sara E. Raymond) — had been her supervisor when she was previously employed as an assistant Public Defender.

However, Judge McElroy failed to disclose that at or about the time the hearing in question was taking place, she accepted as a gift from Mr. Keane an overseas trip.

Even more troubling is the fact that at or about the time the trip took place, Golden Gate University and the student in question were in the midst of litigating a civil case the student had filed in San Francisco Superior Court.

In yet another instance, McElroy’s penchant for destroying the official records of her own courtroom also manifested itself during the proceedings against Respondent Khanna.

Feeling victimized, Mr. Khanna advanced an action against McElroy in federal court. Below is part of an order authored by Magistrate Judge Edward M. Chen. The order alluded to the alleged destruction of the court official record.

In yet another instance of McElroy’s misconduct is the case of William G. Wells. In addition to McElroy’s complete disregard to a specific and detailed order issued by Judge JoAnn Remke– the presiding judge of the court.

McElroy’s was accused of being biased and hostile. Below is an excerpt of pleadings prepared by attorneys from the firm of Christa & Jackson which represents Mr. Wells

The enmeshment between Thomas Girardi and the State Bar of California and others has been the subject of extensive coverage on TLR in connection with former crack addict Mike Nisperos ; BOG public member Jeannine English; State Bar of California Investigator Tom Layton; State Bar of California Executive Director Joe Dunn; allegations of preferential treatment leveled by ethics specialist David Cameron Carr; the attorney-client relationship between Howard Rice and Girardi & Keese; matters relating to the MGA/ Mattel litigation; as well as allegations involving conflicts of interest involving the case of Fogel v. Farmers.

Pierce Henry O’Donnell, a Democratic Party operative associated with the Girardi Syndicate –  was released from federal prison on July 3, 2012, TLR has learned.

O’Donnell has been found guilty of a “serious crime” which involves misrepresentation, fraud, deceit or the use of dishonesty by funneling illegal campaign contributions to former Sen. John Edwards.

He begun serving his 60 day prison sentence on May 7, 2012 in the confines of The United States Penitentiary (USP) in Lompoc, California, which houses medium security male inmates.

O’Donnell has been involved in countless legal proceedings involving his numerous acts of misconduct, described briefly below:

1. Criminal proceedings in the Los Angeles County Superior Court relating to unlawful contributions to James Hahn.

2. State Bar of California Court proceedings relating to his conviction of crimes involving moral turpitude in the Los Angeles County Superior Court.

3. State Bar of California alternative proceedings relating to his mental illness (O’Donnell failed to comply with the conditions of the program and his participation was terminated).

4. Administrative proceedings advanced by both the City of Los Angeles and the State of California.

5. State Bar of California Court proceedings relating to his attempt to mislead a Nevada state court.

Separately,and as was reported HERE earlier, Petitioner Pierce O’Donnell is asking Judge Thomas Anderle of the Santa Barbara County Superior Court for “legal separation” from spouse Dawn O’Donnell.

California Attorney General Kamala Harris , Deputy Attorney General Leslie McElroy , as well as Jon Streeter and John Keker of San Francisco-based Keker & Van Nest are under heavy scrutiny, TLR has learned.

According to sources seeking anonymity, despite the fact that YR had suspected for many months that disbarred attorney Ronald Gottschalk is trying to derail him, and otherwise sabotage his various inquiries (into CaliforniaALL, Howard Dickstein, In Re Girardi, Tony West, Jeffrey Bleich, Kamala Harris , and Jon Streeter) YR nevertheless remain in daily contact with Gottschalk — former member of the Girardi Syndicate — in order to obtain additional information from him, and that because he had felt sorry for him.

Per the sources, within the last few weeks, Gottschalk has grown increasingly abusive and unhappy over the latest revelations YR managed to unearth dealing with Chris Young, Jeffrey Bleich, Kamala Harris, Tony West, and Jon Streeter.

According to the sources, around 5 days ago, when YR categorically informed Gottschalk that he will not cease from further exploring leads dealing with Kamala Harris, John Keker, Jon Streeter, Chris Young, and Jeffrey Bleich in connection with CaliforniaALL, California Bar Foundation, and Obama for America; an abusive Gottschalk stated that John Keker will “Crush” YR.

Additionally, the sources maintain, Gottschalk has tried ad nauseam to convince YR to stop forwarding any developments dealing with the above inquiries and actors to The Leslie Brodie Report, claiming, for example, that they are “boring.”

Nevertheless, YR had managed to outfox Gottschalk by connecting the various dots which reveal a civil action filed last year by Deputy Attorney General Leslie McElroy against Gottschalk (seeking the recovery of $300,000.00 on behalf of the people of the State of California) is not being properly prosecuted by Leslie McElroy (i.e. no opposition was filed to a demurrer filed by Gottschalk, etc) as potential form of quid pro quo between McElroy and Gottschalk (on behalf of Kamala Harris, mentor John Keker, and Jon Streeter) by which Gottschalk will serve as a “mole,” and otherwise sabotage YR and his inquiries; and if necessary –  intimidate him.

Previously, Gottschalk had attempted to convince YR to retain the services of an Oakland-based attorney — who turns out, conveniently, to be an Ex-Keker & Van Nest.  He had also informed YR that he will be beaten similar to the alleged beating inflicted on Erin Baldwin and Joseph Zerrnik — if YR continues to pursue leads concerning Thomas Girardi and Joe Dunn.  See here:  http://tinyurl.com/7anaewa
